I can't figure this out

I have tried a couple of times to buy a henchman but it says I can't use it. Why can't I? I'm a level 37 ice.

Henchmen can only be purchased during a duel. Next time you're in a duel, open the Crowns panel during your turn and you should be able to buy a henchmen.
